Blythe Terms & Conditions

These terms apply when you order from Blythe at blythe.house. Please have a read before you order. They're short on purpose.

1. About us

Blythe makes seasonal planting collections for the home.

Blythe is run by Chloe Jutteau, trading as Blythe, as a sole trader.

You need to be 18 or over to order from us.

2. Where we deliver

We deliver to addresses in England, Scotland and Wales.

We can't currently deliver to Northern Ireland, the Channel Islands or the Isle of Man. Live plants and bulbs sent to those places need separate plant health paperwork that we don't yet hold. We're sorry, and we'll say so on the site the moment it changes.

3. What's in a collection

Every Blythe collection is a complete seasonal planting scheme: a reusable planter, living plants, bulbs, peat-free coir compost and nutrients, decorative finishing items, and a printed planting plan with care notes. You plant it yourself, and the plan tells you exactly how.

Each collection comes in three versions, for Sun, Part Sun and Shade. The plants and bulbs can differ between them, so that the planting actually suits the light it's going into, while the overall character and colour palette stay the same.

That means the plants you receive may not be the ones shown in photographs of a different light version.

4. Choosing your light conditions

There's guidance on the site to help you choose between Sun, Part Sun and Shade. Pick the one that most closely matches where the planter is actually going to live.

If you're unsure, send us a photo of the spot and we'll be glad to help you choose.

Anything we suggest is based on what you've told us and shown us. Light changes through the year and no two corners of a garden behave the same way, so we can't promise how a particular plant will perform in a particular spot.

5. Living plants and natural variation

Plants, bulbs and natural materials are living things, and no two are alike.

Expect variation in size, shape, colour, fullness and maturity. Plants may be at different points in their growth cycle when they arrive. Bulbs are often dormant and completely invisible when your collection turns up, and will emerge later in the season.

Photography on our site shows the overall style and character of a collection, sometimes at a later stage of the season than the one you'll receive. Your individual plants won't be identical to the ones photographed.

None of that is a fault. It's what buying something alive looks like.

6. Substitutions

We select the plants and bulbs for each collection based on the overall design, season and the light conditions you choose.

Because we work with living, seasonal stock, availability and quality can change at short notice. We may substitute individual plants or bulbs where needed.

Any substitution will be selected to maintain, as closely as reasonably possible, the overall look, colour palette, growing requirements, suitability for your chosen light conditions and value of the collection.

If a substitution would materially change the overall character of the collection, we'll contact you before dispatch.

7. How the season unfolds

Blythe collections are designed to change.

Plants grow, flower, change colour and die back. Bulbs sit unseen for weeks before they appear. Flowering times and growth rates on our site are indications, not promises: weather, temperature and light all move them around.

What arrives on your doorstep is one stage of a planting scheme, not the finished thing.

8. Growth, flowering and longevity

Plants and bulbs are living products, and we can't guarantee future growth, flowering or how long any individual plant lasts.

How they do depends on things neither of us controls once the collection is with you: light, temperature, weather, watering, drainage, how it's planted and how it's cared for.

We give you a planting plan and care notes to give your collection the best possible start, but plants may grow or flower differently from the examples and timings on our site.

None of this affects your legal rights. If something arrives damaged, dead, unhealthy or not as we described it, section 14 explains what happens.

9. Looking after your collection

Your collection comes with a planting plan and care notes. Please unpack the plants soon after they arrive and follow the guidance, particularly on watering and drainage.

We're responsible for your collection being of satisfactory quality, fit for the purpose we described and as we described it, when it reaches you. We're not responsible for a plant that arrives healthy and then declines because of the conditions or care it's had since.

If you're not sure which of those you're looking at, send us a photo. We'd rather look at it than have you guess.

10. Keeping everyone safe

Some plants and bulbs can be harmful if eaten or may cause skin irritation. Please don't eat any part of the collection, keep plants and bulbs away from children and pets, and wash your hands after planting. If you have sensitive skin, we recommend wearing gloves when handling plants and bulbs.

The planting plan will list the plants and bulbs included in your collection by name so you can find further information about them.

11. Orders, prices and payment

When you place an order you're offering to buy the collection on these terms. We'll email to confirm we've received it. The contract between us starts when we email you to accept the order.

All prices are in pounds sterling and include any VAT that applies. We're not currently VAT registered, so there's no VAT to add.

The full price you'll pay, including delivery, is shown before you place your order. We don't add anything at checkout that we haven't already shown you.

We take payment when you place your order via Shopify. Payment is by the methods offered at checkout.

Our collections are made in small, genuinely limited quantities and do sell out.

Occasionally we may not be able to accept or fulfil an order, for example if a collection has sold out, we can't deliver to your address, or there's been a clear error in the price or description. If that happens after you've paid, we'll email you and refund you in full.

Very occasionally we might get a price obviously wrong. If the mistake is one you could reasonably have spotted, we may cancel your order and refund you in full rather than supply at that price. We won't do that once your collection has been dispatched.

12. Delivery

We'll tell you when we expect to dispatch before you order, and we'll email you when your collection is on its way. Unless we've agreed something different with you, we'll deliver within 30 days of the day you place your order.

Because we're sending living plants, we sometimes hold a dispatch back: a hard frost, a heatwave, or a batch that arrives and isn't good enough. If that happens we'll email you with a new date. If that date is significantly later than the one we originally gave you, you can cancel and we'll refund you in full.

Your collection is our responsibility until it's in your hands, or the hands of someone you've asked to take it in. If it's lost or damaged on the way to you, that's on us.

Please double check your delivery address. If you spot a mistake, email us straight away. We can usually change it before dispatch, not after.

If a delivery fails because the address was wrong or incomplete, or because the parcel wasn't accepted or collected, we'll let you know. If you'd like us to send it again, we'll charge you what it actually costs us to do so, and we'll tell you the amount before we send anything. Living plants don't always survive a second trip, and we'll be straight with you about the condition before we resend.

13. Changing your mind

Before your collection is dispatched

If you change your mind before your collection has been dispatched, email chloe@blythe.house as soon as you can. If we're able to stop your order before dispatch, we'll cancel it and refund you in full.

After your collection is dispatched

Blythe collections contain living plants and bulbs which can deteriorate rapidly. The statutory 14-day cancellation right for online purchases does not apply to goods that are liable to deteriorate or expire rapidly.

Because each Blythe collection is sold as a single seasonal planting collection containing living plants, bulbs and planting materials alongside a reusable planter, please contact us before ordering if you have any questions about cancellation rights relating to your collection.

This does not affect your statutory rights if anything arrives faulty, damaged, unhealthy or not as described. Please see section 14.

14. If something's wrong

Plants move about in transit. Some displaced compost, or minor cosmetic marks that don't affect the health of a plant, are part of sending something living through the post.

Anything beyond that, please tell us. If your collection arrives damaged, missing something, dead, unhealthy or not as we described it, email chloe@blythe.house as soon as you can, with a photo if you have one, and we'll put it right.

You have rights under the Consumer Rights Act 2015: goods must be of satisfactory quality, fit for purpose and as described. If they aren't, you're entitled to a refund, repair or replacement depending on the circumstances. Nothing in these terms takes those rights away or makes them harder to use.

15. If something goes wrong between us

If you have a complaint, please email chloe@blythe.house and we'll work with you to resolve it.

16. Product information

We take real care to keep descriptions, photographs, prices and other information on our site accurate.

Because our collections contain living and natural materials, photographs and descriptions show the overall look rather than guaranteeing the exact appearance of an individual plant or collection. Colours can also look different from screen to screen.

If we find a significant error affecting something you've ordered, we'll contact you as soon as we can.

17. Things outside our control

If something genuinely outside our control stops us fulfilling your order (severe weather, a courier failure, a supply interruption), we'll contact you as soon as we can and agree a new date. If the delay is significant, you can cancel and we'll refund you in full.

18. Our responsibility to you

We're responsible for loss or damage you suffer that's a foreseeable result of us breaking this contract, or of us failing to use reasonable care and skill. We're not responsible for loss or damage that isn't foreseeable.

We don't exclude or limit our responsibility to you in any way it would be unlawful to do so. That includes responsibility for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, and for your statutory rights as a consumer.

We supply Blythe collections for private and domestic use. If you use one for any commercial purpose, we won't be liable to you for loss of profit, loss of business, business interruption or loss of business opportunity.

19. Intellectual property

The content of the Blythe site, including our photography, text, branding, graphics, planting plans and designs, belongs to Blythe or is used with permission. Please don't copy or reproduce it for commercial purposes without asking us.

Photographs you take of your own collection belong to you. If we'd like to share one, we'll ask you first.

20. Your personal information

We use your personal information to process and fulfil your order, and for the other purposes set out in our Privacy Policy. Please have a look at that for how we collect, use and protect it.

21. Changes to these terms

We may update these terms from time to time. The version that applies to your order is the one in force when you place it.

22. Governing law and where you can bring a claim

These terms are governed by the law of England and Wales.

If you live in England or Wales, you can bring legal proceedings in the courts of England and Wales. If you live in Scotland, you can also bring legal proceedings in the Scottish courts.

Nothing in these terms affects any mandatory consumer rights you have under applicable law.
